Ad-hoc-release – Final judgment in damages proceedings against former board members

In the appeal proceedings before the Düsseldorf Higher Regional Court regarding the Company’s claims for damages against its former CEO XX and its former Supervisory Board Chairman Manfred A. Wagner in connection with the “sbr” complex, the defendants withdrew their appeals shortly before today’s announcement date. Thus, the first-instance judgment of the Regional Court Duisburg dated April 29, 2019, became final and conclusive, by which Mr. XX and Mr. Wagner as co-debtors were ordered to pay damages in the amount of EUR 1,022,676.03 plus interest and the defendant XX was also ordered to pay damages in the amount of a further EUR 414,452.05 plus interest (see ad-hoc publication dated April 30, 2019). According to an approximate calculation, the interest accumulates to approximately EUR 280,000. EASY SOFTWARE AG’s further proceedings for damages against Manfred A. Wagner in connection with the “ScanOptic” complex are still pending.
